New Requirements for Conducting Legal Practice in Australia​

From 31 March 2026, most lawyers in Australia will be required to comply with the Anti-Money Laundering and Counter Terrorism Financing Act 2006 (Cth).
Among other things, this legislation targets businesses which provide services that may enable money from the proceeds of crime or tax evasion to be laundered into and concealed within the legitimate economy. Those businesses must enrol with the regulator AUSTRAC, conduct a risk assessment of their business, establish policies to manage the risks, and report certain things to AUSTRAC.
Most law firms provide services in the relevant categories, and so the law firms are businesses which will be regulated. For example, the regulated activities can include:
advising on or acting in connection with a sale or purchase of real estate or a company/business;

planning for or advising on equity or debt financing of a company/business, trust or partnership;

planning for, advising on or establishing an association, company, partnership or trust;

transferring a shelf company;

providing a registered office for a company; and
-
acting as a director, secretary or attorney (under power of attorney) for an entity (that is not an entity that is personal to or controlled by the lawyer).
These are only examples and are not a complete list.
